Medical marijuana isn’t legal in Massachusetts (yet) but two years ago possession of any pot (to a maxium quantity of one ounce) was decriminalized, and made a civil offense rather than a criminal one

That was a great first step, but on Tuesday the Massachusetts Supreme Judicial Court (SJC) improved upon the 2008 decision: it ruled that the mere odor of marijuana smoke was not enough to give law enforcement officers the right to order a driver or passenger to leave their parked vehicle, as long as driving under the influence was not an issue.

We applaud the Massachusetts SJC for this decision, but think they should follow the West Coast in making medical marijuana a legal option for its citizenry.
